Chapel Hill to appeal order on cell phone ban

CHAPEL HILL, NC (AP) — Chapel Hill will appeal a judge’s order blocking the town from enforcing a ban on cell-phone use while driving.

Mayor Mark Kleinschmidt said Wednesday night the documents could be filed with the Court of Appeals within days.

Superior Court Judge Orlando Hudson on Aug. 3 said the legislature already has regulated the use of cell phones and the town could not impose more restrictions.

The town is also appealing the judge’s order blocking the town’s towing ordinance. Hudson said the towing ordinance was an unconstitutional regulation of trade.

The mayor said it could be spring before a decision is issued.
