Trooper cleared of sex assault allegations
WILMINGTON, NC (WWAY) — After months of investigating, a Wilmington-based Highway Patrol trooper will not face charges in connection with a woman’s claims he raped her last summer.
District Attorney Ben David said at a morning news conference that investigators determined the sexual encounter between Tpr. Bryan Phillips and a Brunswick County woman was consensual based on the hundreds of text messages, many explicit, the two exchanged before and after the incident.
Back in July the woman reported Phillips raped her in his Wilmington home after they met on an online dating site. David said investigators considered charging the woman with giving false information to law enforcement. David said she has been convicted of that crime in Virginia.
Phillips has been on administrative duty while the allegations were under investigation. That continues as the Highway Patrol conducts its own internal investigation now that the criminal probe is over.
