FIRST ON 3: Mistrial declared in baby mauling death; case dismissed

ELIZABETHTOWN, NC (WWAY) — A mistrial has been declared in the case of a young mother charged in the 2011 dog mauling death of her nine-day-old daughter.

After a judge declared a mistrial in Chelsea Lynn Brigman’s manslaughter trial, he also granted a defense motion to dismiss the case. Prosecutors said they would not appeal the judge’s decision, bringing the case to a close.

Jurors had begun deliberating yesterday afternoon and returned to the jury room this morning. In a note to the judge yesterday, the jury said they were split nine to three but did not indicate which direction they were divided.

Prosecutors said Brigman left her baby alone with a number of dogs around in their Clarkton home on August 30, 2011. An autopsy report says Brigman was inside the home with her father-in-law, two male friends and five dogs. Brigman told investigators that she went to take a shower, leaving nine-day-old Addyson Camerino in her car seat on a table with her father-in-law and the male friends.

According to the report, Brigman said she was in the shower 5-10 minutes when the father-in-law called out her name and said, “Your baby!” When she came back into the room, Addyson was on the floor face down in a pool of blood.
