Judge tosses lawsuit over NC public records law

CHARLOTTE, N.C. (AP) – A judge has dismissed a lawsuit alleging that Carolinas HealthCare System broke the state public records law.

The Charlotte Observer reports (http://bit.ly/13y96GE) that the dismissal order signed Monday cited a segment of the N.C. public records law stating that settlement documents are public records “in any suit, administrative proceeding or arbitration instituted against any agency of North Carolina government.”

Charlotte attorney Gary Jackson accused the health care system of keeping secret the terms of a settlement. Carolinas HealthCare won a confidential settlement in a complaint it filed against the former Wachovia Bank in 2008.

Three year later, the system agreed to settle that case confidentially and refused to release a copy of the agreement.

Jackson said he will appeal the ruling to the N.C. Court of Appeals.
