NC judge dismisses charge in SBI case

Wednesday, September 14th, 2011

RALEIGH, NC (AP) — A North Carolina Superior Court judge has dismissed a contempt charge against a former State Bureau of Investigation agent whose testimony led to the release of a Raleigh man who had served almost 17 years in prison for a murder he didn’t commit.

Judge W. Osmond Smith III ordered the dismissal of the charge Wednesday after the completion of a mediation process involving former SBI agent Duane Deaver and the state Innocence Inquiry Commission.

The commission had accused Deaver of being intentionally misleading during testimony in 2009 in a landmark case that ended with the exoneration of Greg Taylor.

The mediator’s report says Deaver acknowledges his testimony was confusing. In exchange, the commission agreed to the dismissal of the contempt charge.
