Hearing involving NC Racial Justice Act continues

FAYETTEVILLE, NC (AP) — The first evidentiary hearing involving North Carolina’s Racial Justice Act appears to be nearing the end in a Cumberland County courtroom.

Attorneys for Marcus Robinson are expected to present rebuttal witnesses Tuesday. Closing arguments could begin after that testimony or they may begin later in the week.

Robinson is a black man trying to prove racism played a role in the death penalty he received for killing a white teenager in 1991. If he proves his claim, the Racial Justice Act calls for him to be sentenced to life in prison without parole.

The Legislature tried to repeal the act earlier this year but failed to override a veto by Gov. Beverly Perdue.

Crash victims were not wearing seat belts

WILMINGTON, NC (WWAY) — Three people are dead after their SUV crashed into a tree last night in Wilmington. Investigators say none of the passengers were wearing a seat belt.

The accident happened at 10:22 p.m. at the intersection of Forest Hills Drive and Colonial Drive. Wilmington Police say a Dodge SUV with four passengers was speeding when it hit the tree.

Two female passengers died at the scene. The male driver was taken to New Hanover Regional Medical Center where he later died. The other male passenger is in the hospital and is expected to survive.

The names of the victims have not yet been released. There is no word yet on whether drugs or alcohol were involved.

NC DSS worker pleads guilty to fraud

GRAHAM, NC (AP) — A former Alamance County Department of Social Services employee has pleaded guilty to taking more than $4,000 in food stamps and government assistance fraudulently.

The Times-News of Burlington reported that 34-year-old Leslie S. Hundley of Burlington pleaded guilty Monday and agreed to repay the county.

Hundley was fired in August from her job processing social services claims. Prosecutors say she fraudulently obtained food stamps, public assistance and medical assistance. She was accused of omitting money paid to her in child support for her two children when she applied for assistance through DSS.

Prosecutors say the benefits were taken between 2009 and 2011.

Superior Court Judge Wayne Abernathy placed Hundley on supervised probation for one year. She also was ordered to pay court costs.
