Teens charged with attempted abduction of boy

Judge: Race played role in NC racial justice case

FAYETTEVILLE, NC (AP) — A North Carolina judge has ruled in a precedent-setting case that race was a factor in prosecution decisions to reject potential jurors who were black.

Superior Court Judge Greg Weeks ruled Friday in Fayetteville that, since race played a significant factor in his sentence, death row inmate Marcus Robinson’s sentence should be vacated.

Weeks then converted Robinson’s sentence to life without parole

North Carolina’s 2009 Racial Justice Act allows death row prisoners and capital murder defendants to use statistics and other evidence to show racial bias played a significant role in prosecutors’ decisions or their sentences.

North Carolina and Kentucky are the only states with laws like it.

Robinson’s case is the first test of that law. Prosecutors said they would appeal Weeks’ ruling.

Body pulled from Cape Fear River

WILMINGTON, NC (WWAY) — A body has been found in the Cape Fear River. Wilmington Fire Department spokesman David Hines says crews recovered the body on the Brunswick County side of the river about half way between the Cape Fear Memorial Bridge and the state port.

Hines and a Wilmington Police Department spokeswoman say there’s been no positive identification. They also say an ID could take days.

A WFD boat crew found the body while patrolling after someone reported seeing some clothing in the area.

The discovery comes after crews searched earlier this week for Marine LCpl. John J. Pruitt, who was stationed at Camp Lejeune after he was reported missing in the river Sunday night. At this point there’s no word on if investigators believe the body is Pruitt.

Two teens charged in attempted abduction of 10-year-old

WILMINGTON, NC (WWAY) — Two teenagers are in jail accused of trying to kidnap a 10-year-old walking home from Pine Valley Elementary School earlier this week. Suspects 18-year-old Mark Christopher Sewell and 16-year-old Jacquelyn Crystal Martin each face charges of Attempted Felonious Restraint and Misdemeanor Stalking.

WWAY has learned that the suspects followed the 10-year-old in their car asking, “”What’s your name? What’s your address?” and “Hey kid, you want some candy?”

The victim ran into the woods and hid until he felt safe enough to run home. The victim’s father decided to drive through the neighborhood and located the vehicle described by his child. Sheriff’s Deputies met with the victim’s father; after multiple interviews, detectives secured warrants and arrested the two suspects in the attempted abduction.

Sewell and Martin were released on $10,000 secured bond. The investigation continues.
