NC Supreme Court rejects Laurean appeal

RALEIGH, N.C. (AP) – A ruling by the N.C. Supreme Court will allow a wrongful death lawsuit against a former Marine convicted in the death of a pregnant colleague to proceed.

Cesar Laurean was convicted by a jury in August 2010 of first-degree murder in the bludgeoning death of 20-year-old Lance Cpl. Maria Lauterbach. He is serving a life sentence.

Court officials said Monday’s decision will allow a wrongful death lawsuit filed by the Lauterbach family against Laurean and his now-former wife to move forward. The litigation was stayed last year until after Laurean’s chances at appeal could be determined.

Laurean’s appeal claimed his constitutional rights were violated by a judge who didn’t allow the jury to consider second-degree murder as a possible verdict based on a lack of evidence of premeditation.

7-year-old NC girl killed by truck at bus stop

TARBORO, N.C. (AP) – Authorities say a 7-year-old Edgecombe County girl is dead after she was struck by a pickup truck while she waited for a school bus with three of her siblings.

The N.C. Highway Patrol said Janell Simmons ran from the shoulder of N.C. 43 into the path of the truck shortly before 7 a.m. Thursday. The patrol said the truck driver slowed down for the bus and the children

Janell was transported to Nash General Hospital, where she was pronounced dead a short time later.

Patrol spokesman Sgt. Jeff Gordon said the truck driver will not be charged in the accident.

Janell was about to attend her fourth day at G.W. Bulluck Elementary School, where social workers, counselors and psychologists were sent to provide counseling and advice to teachers.

Police investigating shooting at Campus Walk apartments

Wilmington police are investigating a Thursday evening shooting after a bullet grazed a woman on the leg while she was in an apartment on Racine Drive.

FIRST ON 3: Pender County shooting under investigation

PENDER COUNTY, NC (WWAY) — The Pender County Sheriff’s Office responded to a shooting in Maple Hill this evening.

Investigators say around 5 p.m., Ryan Mullins of Swansboro was shot in the leg during an alleged robbery attempt at the intersection of Webbtown and Wooten Roads.

Mullins was airlifted to New Hanover Regional Medical Center. The Sheriff’s Office says word from the hospital is that he will be released tonight.

The investigation continues.
