DSS seeks power over adult care homes

N.C. departments of social services should have the power to enforce adult care and nursing home regulations as well as investigating reports of violations, New Hanover County DSS Director LaVaughn Nesmith said Tuesday.

Man with Parkinson’s drowns at Topsail Beach

TOPSAIL BEACH, NC (WWAY) — Topsail Beach Police say a man with Parkinson’s disease drowned in the ocean early yesterday morning.

Police say the victim is Lester Howard Mason, 69, of Topsail Beach. Police say Mason was swimming behind his home on Carolina Boulevard yesterday morning. Emergency crews found his body around 6:15.

Investigators have not yet determined what led to his drowning. Officers say Mason was a strong swimmer and swam recreationally.

Topsail Beach Police say Mason was well-liked in the community and he will be missed.

One man wanted, four more surrender in Loris shooting

LORIS, SC (WWAY) — Two Columbus County men have turned themselves in to police in connection with a shooting in Loris, SC, earlier this month. David Hemingway, 20, and Xavier Hemingway, 17, both of Tabor City, turned themselves in Monday. Both face six charges of attempted murder and a burglary charge after a shooting into a home. Loris police are still looking for Dustin Stackhouse.

WPDE in Myrtle Beach reports Loris Police Chief Joe Vaught said a number of people approached a home on Watson Street about 4:30 a.m. on August 9 and started shooting. Police believe this shooting is connected to another incident in a church parking lot in Tabor City later that night in which David Grubbs was shot in the neck and face.

Amanda Hardee turned herself in last week and is charged with six counts of attempted murder. Christopher Green turned himself into Columbus County authorities. He is awaiting extradition.

NC Court of Appeals upholds lower ruling on pre-K

RALEIGH, NC (AP) — An appeals court has upheld a lower court decision that says North Carolina cannot deny at-risk children admission to the state’s pre-kindergarten program.

A three-judge panel of the Court of Appeals ruled unanimously Tuesday against attorneys for the state who argued a Superior Court judge went too far in throwing out legislative changes last year to the North Carolina Pre-Kindergarten program.

Those changes included limits on the number of children considered at-risk that could be served and required some co-payments for the free program.

Appeals Court Judge Rick Elmore wrote that state attorneys misinterpreted the order to mean legislators must provide pre-kindergarten to all at-risk 4-year-olds in North Carolina. Elmore said the order was about eliminating artificial barriers to enter the program.

The Legislature dropped those limitations this year.
