ONLY ON 3: Alderman’s son files federal suit against Wrightsville Beach, police officers

Tuesday, August 27th, 2013

WRIGHTSVILLE BEACH, NC (WWAY) — The Town of Wrightsville Beach and two of its police officers are facing a federal lawsuit filed by the son of a town leader.

In 2011 Darryl Mills was elected to be an alderman in Wrightsville Beach. Just a few hours later his son Adam was stopped by Wrightsville Beach Police and charged with DWI. That stop now has the town in federal court facing allegations of civil rights violations.

According to the suit Adam Mills claims he was verbally assaulted by officers Jimmy Rich and Jesse McCubbins after they arrested him on suspicion of DWI in November 2011.

Mills claims he became belligerent to the officers because they were taunting him about the effect the arrest would have on his father. When Mills disobeyed an officer’s order to stay seated on a bench he claims McCubbins punched him in the face. He then claims the officers slammed him face first into the floor breaking his nose and his left orbital wall.

Mills says despite the fact he was bleeding heavily, the officers failed to immediately call for medical assistance. Once EMS did arrive, he was told that they were just there “to make sure he didn’t bleed out.”

According to Wrightsville Beach Town Manager Tim Owens both officers named in the suit are still employed by the town’s police department.

There is video of what happened inside the police department that night. The town’s attorney says it will be released tomorrow.
