WILMINGTON, NC (STARNEWSONLINE.COM) — New Hanover County Commissioner Brian Berger will be responsible for paying his own attorney fees and court costs, the N.C. Superior Court ruled Wednesday.
Last week Berger and his Raleigh-based attorney Chris Anglin submitted a request to N.C. Superior Court for the county to pay for his attorney's fees and court costs, asking the court to determine if the board of commissioner's actions were an "an abuse of discretion" or if Berger's fellow commissioners "acted outside the scope of their legal authority."
Anglin said the first would require the county pay them back and the second would mean it was up to court's discretion.
