Fuzzy Peach sold in deal worth up to $830,000

WILMINGTON, NC (WWAY) — Fuzzy Peach, a self-serve frozen yogurt store started by a group of UNCW graduates with locations in three states, has been sold.

U-Swirl, Inc. announced late last week it has acquired the business assets of Fuzzy Peach Franchising, LLC, for $481,000 in cash. The deal includes all intellectual property and worldwide franchise and license rights, including the rights to 17 Fuzzy Peach stores in North Carolina, South Carolina and Virginia. U-Swirl says the purchase price could increase as much as $349,000 based upon royalty income generated by Fuzzy Peach stores over the next twelve months.

According to a news release, U-Swirl says the purchase will increase its store base by six percent and increase its presence in the southeast. The company will now have 286 locations in 38 states under the brand names U-Swirl, CherryBerry and Fuzzy Peach.

One dead, three in jail after robbery attempt

ONSLOW COUNTY, NC (WWAY) — Three suspects are in jail and a fourth is dead after investigators say a man they tried to rob fought back.

The Onslow County Sheriff’s Office says deputies responded around 7:30 p.m. Sunday to a burglary and gunshot victim at 145 Abbotts Branch Lane near Hubert. Investigators say Brian Bailey, 23, and Michael Holliday, 21, broke into the home while Jonathan Koncir, 22, and Jordan Sanford, 18, waited nearby in a getaway car.

Detectives say while inside the house Bailey and Holliday pointed a 20-gauge shotgun at John Moore and demanded drugs and money. They say Moore pulled out a .22 caliber pistol and demanded the men leave. At some point Holliday was shot.

Investigators say the four suspects headed to a hospital for Holliday. On the way they hit another vehicle on NC 172 in Hubert. Holliday later died at the Naval Hospital aboard Camp Lejeune.

Bailey, Koncir and Sanford are charged with first degree burglary, attempted robbery with a dangerous weapon and conspiracy to commit robbery with a dangerous weapon. They are each in jail under $200,000 bond.

According to the NC Department of Corrections website, Sanford was convicted in August of simple assault, trespass and communicating threats. She was sentenced to 12 months probation.

Court records show Bailey has a pending court date next month on drug charges.
