DA speaks against Constitutional amendment on NC ballots

WILMINGTON, NC (WWAY) — There’s a Constitutional amendment on your ballot in this election, but do you know what it’s all about?

District Attorney Ben David Monday warned voters about the amendment at the League of Women’s Voters of the Lower Cape Fear luncheon.

It is known as the “Jury Waiver Amendment.” If voters pass this, it would allow any person accused of a crime other than one in which the state will seek the death penalty to waive their right to a trial by jury and instead have a trial by judge.

Supporters say it will help speed up the judicial system and save money, but David says district attorneys around the state are against this amendment.

“The reason is we are all for streamlining the process. We don’t believe that will do that,” David said. “In fact we think it’ll take the most important component out of the justice system and that is we the people.”

David also says if the amendment passes, then both sides should have a say in the trial process and not just the defendant.
