Man accused of 2012 murder pleads guilty to accessory after the fact

Monday, October 27th, 2014

WILMINGTON, NC (WWAY) — A man charged in the murder of 22-year-old David McPhatter has pleaded guilty to lesser charges.

Codey Guerrero appeared in a New Hanover County Courtroom and pleaded guilty to accessory after the fact of a 2nd degree murder. As a part of the plea deal, a judge dismissed his 1st degree murder charge.

Prosecutors say the conflict began because Guerrero and Robinson wanted McPhatter to join their gang, but he refused. They say during a cookout off Castle St. in Wilmington, Guerrero and Terrell Robinson confronted McPhatter. Prosecutors say Guerrero hit McPhatter. Then, they say Robinson shot McPhatter three times, killing him.

Earlier this year, Robinson pleaded guilty to second-degree murder and was sentenced to 13 to 17 years in prison.

Guerrero will serve 5 to 7 years in prison.

Guerrero’s friends and family showed up to support him. They say they are satisfied with the outcome.

WILMINGTON, NC (WWAY) — Police are investigating after they say a man was stabbed in the back twice during an attempted robbery while he was walking home Friday night.

Wilmington Police say they discovered the stabbing victim at New Hanover Regional Medical Center soon after the crime happened. They say the man told them he was walking home in the 1500 block of S. 12th Street when two men approached him from behind.

Officers say the duo demanded cash from the man, but he told them no, thinking it was a joke. That’s when police say the man felt something hit his lower back. They say the man started swinging at the duo until they ran away.

Police say the victim had two puncture wounds to his lower back, but is expected to be OK. They say the man was not able to provide a description of the men because it was too dark.
